The available Types of Damages Following a Major New Hampshire Car Accident

August 18, 2020

Every time a driver gets behind the wheel, there is a small chance that something will go terribly wrong. However, the risk of an accident occurring is often higher when certain external factors are at play. For example, dangerous road conditions, inclement weather, and other reckless or distracted drivers can all add to the daily dangers that drivers face.

In a recent news report, a local Manchester man is facing multiple charges following a major car accident. The man who caused the accident suffered from schizophrenia and allegedly threatened to kill his parents before stealing their SUV and crashing it. Local authorities on the scene reported that the stolen SUV exceeded 100 miles per hour several times before crashing into the rear of a Subaru Outback.

The collision sent the Subaru off the highway, rolling multiple times and injuring the driver and passengers. In the Subaru, all three individuals who were in the vehicle were transported to a local hospital for treatment of their injuries. The family’s dog was also transported to a local vet with life-threatening injuries.

Following the accident, the man who caused the accident escaped into the nearby woods. State troopers and authorities canvassed the area with the help of a state police dog and the man was taken into custody after the search was conducted. He was uninjured.

The man’s parents informed the police that prior to the accident, the family had had an altercation where the man had struck his father in the face and threatened to kill him and pushed his mother to the ground before taking the car keys. The parents claimed that they believed their son would have killed them. The man now faces charges of robbery, theft, misdemeanor domestic assault, and criminal threatening.

After a major accident, especially one as complicated as these collisions may get, filing a claim may be the furthest thing from your mind. However, a personal injury lawsuit may help offset many of the costs that were caused by the accident and can help ease some of the pressure on the road to recovery.

In New Hampshire, there are several types of compensatory damages available for plaintiffs. Economic damages can cover past and future medical expenses, lost wages and benefits, and loss of earning capacity. Non-economic damages can be recovered for pain and suffering, disabilities that occur as a result of the accident, or emotional distress. In New Hampshire, punitive damages are rare, but may be available in some situations in which the at-fault party’s actions were oppressive or malicious.
